Terms and conditions

Agreement

These Terms and Conditions (“Agreement”) govern your access to and use of the Akkad Platform, including, but not limited to, its main domain and any related subdomains (collectively referred to as the "website" or "digital platform").

By accessing or using the Akkad Platform, you agree to be bound by the terms and conditions set forth in this Agreement.

Please read these terms carefully before using the platform

Account and Responsibility

When you register on the Akkad Platform, you are solely responsible for maintaining the confidentiality of your account information, including your username and password, and you agree not to share your login credentials with any third party.

You are legally accountable for all activities conducted through your account, whether authorized by you or not. If you suspect any unauthorized use of your account, you must immediately notify the platform administration via the official communication channels.

The Department of Foreign Economic Relations reserves the right to suspend or terminate any account in cases of misuse, violation of these terms, or for any other legal reasons deemed appropriate.

Acceptable Use

By using the Akkad platform, you agree not to engage in the following activities:

  1. Deface, alter or interfere with the front end “look and feel” or content of the website or any linked sites or the underlying software code.
  2. Take any action, which imposes an unreasonable or disproportionately large load on the platform or related infrastructure.
  3. Do anything, which will or might damage, interfere with, disrupt access to, interrupt or impair the functionality of the material available on or through Akkad platform, nor to upload any material that contains any computer viruses or other codes, files or programmed designed to interrupt, destroy or limit the functionality of any software or equipment.
  4. Post, distribute or otherwise upload any defamatory, libelous, offensive, infringing, obscene, indecent, harmful, threatening, abusive, tortuous, racially, or ethnically objectionable or otherwise unlawful material or information or send any chain letters, junk mail, 'spamming' material or any other form of bulk communication, advertising or solicitation.
  5. Uploading, posting, emailing, or transmitting any materials that you do not have the right to transmit under any law or contractual relationship.
  6. Using the Akkad platform to commit any criminal activity or encourage others to engage in conduct that would constitute a criminal offense or give rise to civil liability.
  7. Obtain or attempt to obtain unauthorized access to Akkad platform or any private or member account areas on the website, nor to impersonate any person or misrepresent your affiliation with another person.
  8. Posting any content that infringes on the intellectual property rights of others, or engaging in actions that violate, destroy, or conflict with the intellectual property rights of the Foreign Economic Relations Department, the Government of the Republic of Iraq, or third parties.
  9. The Foreign Economic Relations Department and the Government of the Republic of Iraq have the right to take legal action against anyone engaging in illegal activities such as collecting or storing personal information about others.

If any violation of these terms and conditions regarding the use of the website is detected, the Foreign Economic Relations Department reserves the right to take the following actions:

  1. Delete any material or content that may have been published unintentionally.
  2. Warn you that you have violated these terms and conditions and ask you to cease the behavior.
  3. Take further action, including suspending, terminating, or restricting your access to, and preventing you from using the Akkad platform.
  4. Report your activities to your Internet Service Provider or the relevant authorities and/or pursue legal action against you.

Limitation of Liability

The Department of Foreign Economic Relations – a division of the Iraqi Ministry of Trade – makes every effort to ensure the accuracy and timeliness of the information and services provided on the Akkad Platform. However, the Ministry, its staff, and representatives shall not be held legally or financially liable for:

  1. Any delays or interruptions in service availability.
  2. Any errors or omissions in the content published on the platform.
  3. Any direct or indirect losses resulting from the use of the platform, reliance on its content, or any linked external websites.
  4. Any damages arising from technical failures, security breaches, or viruses that may affect users’ devices due to interaction with the website.

The Department of Foreign Economic Relations applies strict security measures to protect data from loss, misuse, or unauthorized modification. However, the internet is inherently insecure. Accordingly, the website and platform are provided “as is” and “as available” without any express or implied warranties.

Choice of Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws and regulations of the Republic of Iraq, with exclusive jurisdiction vested in the Iraqi courts.

By using the Akkad Platform, you expressly agree to be bound by these terms and conditions, and to submit to the jurisdiction of the Iraqi courts under Iraqi law.

The Foreign Economic Relations Department retains the right to initiate proceedings in your local courts or in any other jurisdiction deemed appropriate based on the nature of the violation or dispute.

Modification of Terms and Conditions

The Foreign Economic Relations Department reserves the right to modify or update these Terms and Conditions at any time without prior notice, as deemed appropriate to enhance user experience or comply with applicable laws and regulations.

The updated Terms and Conditions shall become effective immediately upon being published on the platform, unless explicitly stated otherwise.

It is the user's responsibility to review these Terms and Conditions each time they visit the platform to ensure awareness of any changes. Continued use of the platform following any modifications constitutes implicit acceptance of the updated Terms.

Users are therefore encouraged to periodically review this page to stay informed of any updates.
